Terms of Use

By downloading or using Never Stall you agree to these terms. If you do not agree, do not use the app. They are written to be read, so they are short.
Your licence to use the app
Never Stall is licensed to you, not sold. The licence is Apple's Standard Licensed Application End User Licence Agreement, which you can read at apple.com/legal/internet-services/itunes/dev/stdeula. It applies in full, and these terms add only the parts that are specific to this app.
In short, it lets you use Never Stall on Apple devices you own or control, for your own personal use. Apple is a third party beneficiary of that agreement and may enforce it.
The app itself, its design, its code and its artwork belong to Ludyem AS. These terms do not give you any right to our name or our branding.
Paying for Never Stall
The app is free, and all of it is free. Every quest, every ladder, your level, your six stats, your rank and your whole history are open without paying. There is no subscription, no trial, no paid tier and nothing behind a paywall.
The only thing we sell is freezes
A freeze closes one day as neutral, so a day you could not keep does not break a streak. You earn them as you climb, and if you run out you can buy more. That is the whole of it.
Nothing you buy changes what you have done. A freeze cannot add XP, raise a level, move a stat, change a rank or alter the record of a day you kept. It only ever marks a day neutral, which is the same thing an earned freeze does.
Freezes are consumables
A freeze is used up when it is spent, the way a ticket is. Payment is charged to your Apple Account when you confirm the purchase. Nothing renews, nothing is billed again, and there is nothing to cancel.
The price that counts is the one shown in the App Store at the moment you buy, in your own currency and for your own country. We do not print prices on this page, because they differ by country and change over time.
There is no restore, and that is not an oversight
The App Store does not re-deliver consumables, so a freeze you have bought cannot be restored the way an app or a subscription can. Freezes you have not yet spent live on the device, and in your iCloud data if you use it. The app has no Restore Purchases control, because a control that could only ever say "nothing to restore" would be misleading.
Refunds
Apple sells the app and handles the money, so refunds are Apple's and we cannot issue one for you.
- To ask for a refund: reportaproblem.apple.com. Refunds are Apple's decision under Apple's policy, not ours. If you live in the EEA, your statutory rights as a consumer are unaffected by this.
- To see what you have bought: your purchase history is in iOS Settings → [your name] → Media & Purchases. There is no subscription to manage, because there is not one.
What the app does not promise
Never Stall counts the days you tell it about and works out a target, a level, six stats and a rank from them. It cannot promise an outcome. Whether a habit sticks, whether you get fitter, and whether you feel better are not things any app can guarantee, and we do not.
Not medical advice
Never Stall is not a medical device and does not give medical advice, diagnosis or treatment. When it uses Apple Health, it is reading numbers your own devices recorded and turning them into a starting point and a target. That is a reading of your own data, not a health assessment, and it says nothing about your health.
Talk to a qualified health professional about your health, and about any change in exercise or sleep. If a target the app suggests does not suit you, change it or ignore it. You decide what you do with your body; the app just keeps count.
Using the app properly
Do not reverse engineer, decompile or tamper with the app, resell or redistribute it, use it to break the law, or interfere with Apple's services or with anyone else's use of the app. That is the whole list. The app has no accounts, no social features and no shared content, so there is nothing here about what you may post.
Ending this
You can end these terms at any time by deleting the app. We may end your licence if you materially break these terms, and the licence ends automatically if you stop using the app. We may also stop selling or supporting Never Stall, or withdraw it from the App Store. If we do, freezes you have already bought and not spent stay on your device for as long as the app keeps working, and nothing further will be charged to you. Apple handles any refund that is due.
No warranty
The app is provided "as is" and "as available", without warranties of any kind so far as the law allows. We do not promise it will be uninterrupted, error free, or right about every number. Nothing here removes rights you have as a consumer that cannot be removed by agreement.
Limitation of liability
To the maximum extent the law allows, Ludyem AS is not liable for indirect, incidental or consequential loss arising out of your use of Never Stall. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under the law that applies to you.
Changes to these terms
We may update these terms. The date at the top changes when we do, and using the app after that means you accept the revised version. If a change is material, it will be visible in the app, not only here.
Governing law
These terms are governed by the laws of Norway, where Ludyem AS is established, without regard to conflict of laws rules. Disputes go to the Norwegian courts.
If you are a consumer in the EEA, this does not take anything away from you. You keep the protection of the mandatory consumer law of the country you live in, and you may bring a claim in your own local courts. Consumers in Norway can take a complaint to the Norwegian Consumer Authority, Forbrukertilsynet (forbrukertilsynet.no), and consumers elsewhere in the EEA can use the consumer dispute body in their own country.
