Terms of Service

These Terms of Service ("Terms") govern your use of Tend ("the App"), provided by Ludyem AS ("Developer"). By downloading or using Tend you agree to these Terms. The same terms are available inside the app under Settings → About → Terms of Service.

1. Eligibility

You must be at least 13 years of age to use Tend. By using the App you represent that you are 13 or older. If you are under 18, you confirm that you have your parent or guardian's permission to use the App. The Developer reserves the right to terminate access for any user found to be under 13.

2. Licence

The Developer grants you a personal, non-exclusive, non-transferable, revocable licence to use Tend on devices you own or control, in accordance with Apple's App Store terms.

3. Not a medical device — important health disclaimer

Tend is a personal wellness-tracking utility. It is NOT a medical device. It is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition. The logs, histories, and patterns provided by Tend are for general informational purposes only.

Patterns shown in Tend are statistical associations in your own data. Association is not causation. A pattern is a prompt for a conversation with a professional, not a conclusion.

Do not use Tend as a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay seeking it because of something you saw in Tend. If you experience a medical emergency, contact emergency services immediately.

4. Purchases

Tend Pro is available as an annual auto-renewing subscription or as a one-time lifetime purchase:

• Payment is charged to your Apple ID at confirmation of purchase.
• Auto-renewing subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
• Free trials apply to new subscribers only; any unused portion of a free trial is forfeited when you purchase.
• Manage or cancel subscriptions via Settings → [Your Name] → Subscriptions on your iPhone.
• Refunds are governed exclusively by Apple's refund policy — see reportaproblem.apple.com.

Lifetime purchase: A one-time lifetime purchase grants access to Tend Pro features for as long as the App remains available on the App Store. A lifetime purchase does not guarantee perpetual availability of the App or any specific feature (see section 11).

5. Acceptable use

You agree not to: reverse-engineer, decompile, or disassemble the App; use it for any unlawful purpose; attempt to circumvent purchase validation or security measures; or use Tend in any way that could harm yourself, others, or third parties.

6. Intellectual property

All rights in and to Tend, including its code, design, and content, are owned by the Developer. Your use of the App grants no ownership or intellectual property rights.

7. Disclaimer of warranties

The App is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of the App or reliance on any information provided by it, including patterns and associations. This limitation applies even if the Developer has been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless Ludyem AS and its officers, employees, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your use of the App, your violation of these Terms, or your violation of any applicable law or third-party rights.

10. Governing law

These Terms are governed by the laws of Norway, without regard to conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Norway, unless mandatory consumer protection laws in your country of residence require otherwise.

11. App discontinuation

The Developer reserves the right to discontinue, modify, or remove Tend or any of its features at any time, with or without notice, subject to applicable law. In the event of discontinuation, the Developer will endeavour to provide reasonable advance notice. No refund is guaranteed for lifetime purchases in the event of discontinuation, except where required by applicable law or Apple's refund policy.

12. Apple's terms

Your use of the App is also subject to Apple's App Store Terms and Conditions and the Apple Media Services Terms and Conditions. In the event of a conflict, Apple's terms take precedence for matters within Apple's platform.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

14. Changes

The Developer may update these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.
